DDP vs DAP for Hard-to-Reach Deliveries: Which Incoterm Protects You?

Buy DDP, provided your supplier can legally act as importer of record in the destination country. Under ICC Incoterms 2020, DDP puts import clearance, import duty and every customs formality on the seller. DAP delivers to the same physical point but leaves all of that with you.

What do DAP and DDP actually say?

DAP and DDP are two of the 11 ICC Incoterms 2020 rules that allocate cost and risk between seller and buyer. Both are delivered terms, so both carry the seller a long way. They part company at the border.

Under DAP (Delivered at Place), the seller delivers the goods at the agreed place of destination, ready for unloading from the arriving vehicle. The buyer manages and pays for all import clearance formalities, and the buyer unloads.

Under DDP (Delivered Duty Paid), the seller delivers at that same point, but is responsible for carrying out and paying all customs formalities: export, import, and any transit procedures. The buyer's only remaining obligation is to unload. Those allocations are set out in the ICC's own comparison of DAP and DDP. DDP is the single Incoterms 2020 rule under which the seller pays the import duty.

If you also need the seller to unload, the rule is DPU, not DAP: under DAP the seller does not unload the goods, under DPU the seller does.

Where does risk transfer under each?

At the same place, in both cases. Risk of loss or damage passes to the buyer when the goods are at the buyer's disposal at the named destination, ready for unloading from the arriving means of transport. The difference is not where risk moves. It is who is standing at the customs counter when the consignment arrives.

So write the named place out in full. "DDP South Sudan" is not a delivery point. "DDP consignee warehouse, Bor, Jonglei State" is. Cost and risk run to the words in the contract, not to the destination you pictured.

Why is DDP usually the safer buy into South Sudan?

Because the failure mode on a hard-to-reach delivery is rarely the ocean leg. It is the consignment sitting at a border post or in a Juba yard while an exemption letter, a duty assessment or a clearing agent's file catches up with it. Under DAP that clock, and the storage and demurrage bill attached to it, runs against you, from several thousand kilometres away. Under DDP it runs against the supplier, which is the only dependable way to make the supplier care about it.

Two further points for a procurement or finance officer:

  • Where a humanitarian consignment qualifies for duty and VAT exemption, DDP makes the seller the party that must obtain and lodge that paperwork, and absorb the delay if it is queried or refused.

  • A DDP price is a comparable price. It already contains freight, clearance, duty, handling and inland movement, so two delivered, duty-paid quotations sit side by side honestly. Two ex-works prices do not.

When is DAP the better term?

When the seller cannot clear. ICC is blunt on this: if the seller does not want to manage import clearance, or is prevented from doing so by local rules in the destination country, then DAP is the more suitable rule. Some jurisdictions do not permit a foreign entity to act as importer of record at all, and a DDP contract with a supplier who cannot legally clear is worse than a DAP contract with one who said so upfront.

DAP is also right when your own organisation holds the exemption and clears faster than any commercial agent would, which is often the case for UN agencies and NGOs with a standing duty waiver. Whoever can actually move goods through customs should be the party contracted to do it.

Before signing a DDP order, ask for two things in writing: the legal entity that will act as importer of record, and the delivery point named in full.

No. The Incoterms 2020 rules allocate cost and risk in the contract of sale. Title, payment terms and insurance limits must be written into the contract separately.
